This Privacy Policy describes how Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) collects, uses, shares and protects information in connection with the TASK321 platform, websites, applications, integrations and related services (the “Services”).


IDENTITY OF THE CONTROLLER AND ROLE OF FUSION

1.1 Data Controller.
Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) is the entity that operates TASK321 and acts as the data controller with respect to the personal, commercial, technical, operational and usage information that it collects, generates, receives, stores, organizes, combines, uses, shares, protects, retains, anonymizes or deletes in connection with its websites, applications, APIs, integrations, messaging functionalities, artificial intelligence tools, support systems, administrative dashboards and related services (collectively, the “Services”), to the extent that such processing is carried out for Fusion’s own purposes.
1.2 Fusion’s Own Purposes.
Fusion shall act as data controller when it processes information for its own purposes, including, without limitation:
a. operating, providing, maintaining, protecting and improving the Services;b. registering and administering accounts, access credentials, permissions and configurations;c. authenticating users and preventing fraud, abuse, unauthorized use or security incidents;d. processing subscriptions, payments, renewals, charges, commissions, billing and collections;e. providing technical support, customer assistance, onboarding, monitoring and operational assistance;f. analyzing usage, performance, metrics, incidents, stability, consumption and operation of the platform;g. developing, training, testing, optimizing or improving functionalities, integrations, automations and tools, including tools based on artificial intelligence, to the extent permitted by this Policy and applicable law;h. complying with legal, regulatory, judicial, tax, accounting, evidentiary, audit, security or contractual enforcement obligations;i. protecting the rights, systems, data, intellectual property, reputation, operations and legitimate interests of Fusion.
1.3 Data Managed by Business Users.
When a Business User uploads, imports, manages, processes, synchronizes, uses or enables the processing of personal data of its clients, employees, contractors, leads, contacts, suppliers or third parties within TASK321 for purposes related to its own commercial activity, such Business User shall, as a general rule, be the primary or independent data controller of such data with respect to the purposes determined by that user.
In such cases, Fusion shall act solely in the role appropriate according to the nature of the processing and the applicable legislation, including as a service provider, processor, subprocessor or equivalent role, and shall not thereby assume the status of exclusive or joint controller with respect to the Business User’s decisions regarding the collection, legal basis, accuracy, lawfulness, transmission, commercial use, retention or disclosure of such data.
1.4 No General Assumption of Responsibility for User Data.
Nothing in this Policy shall be interpreted as an assumption by Fusion of general, primary or exclusive responsibility for all data, messages, contacts, content, automations, campaigns, quotations, files, instructions or communications uploaded, sent, generated or managed by the User within the Services for purposes related to the User’s own business.
The User shall remain, in all cases, responsible for defining the purpose, legal basis, scope, accuracy, updating and lawfulness of the data and content incorporated into TASK321 for its own operations.
1.5 Third-Party Control and Integrations.
Fusion shall not be responsible for processing carried out by independent third parties, including payment processors, messaging services, telephony platforms, artificial intelligence providers, identity verification tools, cloud services, analytics services, mapping services, calendars, marketplaces, electronic signature services or other integrations or Third-Party Services, except with respect to the portion of processing that Fusion performs directly under its own control and for its own purposes.
1.6 Privacy Contact Information.
For inquiries, requests or claims related to privacy, data protection or the exercise of rights relating to information processing, the User may contact Fusion at:

Fusion may designate additional or specific channels for privacy requests, data subject rights, security incidents, regulatory inquiries or compliance documentation.
1.7 Updates to Identity or Contact Channels.
Fusion may update its commercial identity, corporate structure, address, contact channels, internal responsible parties or privacy information by publishing such updates within the Services, on the website or through other reasonable means of notification. Such changes shall become effective upon publication or on the date indicated in the relevant communication.
1.8 Protective Interpretation of Fusion’s Role.
In the event of doubt regarding Fusion’s role with respect to a particular set of data or a specific processing activity, this Policy shall be interpreted consistently with the technological nature of TASK321 and with the principle that Fusion does not assume more responsibilities than those expressly imposed by law, by this Policy or by specific applicable agreements.

2. SCOPE OF THIS PRIVACY POLICY

2.1 General Scope.
This Privacy Policy (the “Policy”) governs the manner in which Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) collects, receives, accesses, generates, organizes, records, stores, uses, transmits, shares, protects, retains, anonymizes, aggregates, analyzes, deletes and, in general, processes personal, commercial, technical, operational, usage and any other information associated with access to, use of, contracting of, integration with or interaction with TASK321 and its websites, applications, platforms, APIs, integrations, messaging functionalities, artificial intelligence tools, support services, administrative dashboards, automations and related services (collectively, the “Services”).
2.2 Covered Persons.
This Policy applies, as applicable, to any person or entity interacting with the Services, including, without limitation:
a. website visitors;b. registered users or potential users;c. individual users;d. Business Users;e. administrators, operators, employees, contractors, agents or sub-users of an account;f. customers, leads, contacts or third parties whose data is entered, synchronized or processed through the Services;g. individuals who communicate with Fusion through support, sales, onboarding, automated channels, forms, messages, email, WhatsApp or other means;h. any third party interacting with functionalities, integrations, automations or communications issued from or through TASK321.
2.3 Services, Channels and Covered Environments.
This Policy applies to information processed in connection with:
the TASK321 website and any related landing page, microsite or portal;
mobile applications, desktop applications or web versions of the Services;
APIs, webhooks, SDKs, integrations, plugins, extensions, connectors or modules related to TASK321;
messaging services, email, SMS, WhatsApp, voice, telephony, transcription, recording, automated responses and automations;
tools or functionalities based on artificial intelligence, machine learning, automated classification, content generation, suggestions, quotations, virtual assistants, automated analysis or equivalent technologies;
payment gateways, subscription systems, financial processors, billing and collection systems;
onboarding, support, monitoring, analytics, security, verification, authentication, identity, biometric, electronic signature, calendar, scheduling, mapping, geolocation, marketplaces and other Third-Party Services integrated with or linked to TASK321;
any technical, operational or commercial environment in which Fusion processes information related to the Services.

3. INFORMATION WE COLLECT

3.1 General Categories of Information.
Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) may collect, receive, generate, infer, record, organize or process different categories of information related to the Services, including, without limitation:
a. identification and contact information;b. account and authentication information;c. commercial and billing information;d. transactional and payment information;e. professional or business information;f. content, files, messages and information uploaded by the User;g. information about customers, leads, contacts or third parties incorporated by the User;h. technical, device, network and browsing information;i. usage, activity, metrics and behavioral information within the Services;j. information derived from integrations, APIs and Third-Party Services;k. information related to messaging, automations, voice, telephony, recording, transcription and communications;l. information related to artificial intelligence tools, automations and generated outputs;m. information related to support, onboarding, sales, compliance, audit and security; andn. any other information reasonably necessary to provide, administer, protect, monetize, improve or enforce the Services.

3.2 Information the User Provides Directly.
We may collect information that the User provides directly to us, including, without limitation:
a. first and last name;b. business name, company name, DBA, industry or line of business;c. email addresses;d. telephone number, WhatsApp or other contact details;e. physical address, city, state, country and postal code;f. login credentials, username and account preferences;g. billing information, subscription information, selected plan and payment methods;h. documentation, forms, messages, tickets, inquiries, complaints or responses sent to Fusion;i. configuration, automation, notification, language, integration or permission preferences;j. any other information that the User chooses to upload, share or synchronize with TASK321.

3.3 Account, Security and Authentication Information.
We may collect and generate information necessary to create, administer, protect and authenticate accounts, including:
a. internal account identifiers;b. user roles, permissions and hierarchies;c. password resets, access confirmations and security changes;d. login and logout records, active sessions, expirations, tokens, associated devices and authentication activity;e. information necessary for validation, fraud prevention, access control, compliance or contractual enforcement.

3.4 Commercial and Operational Information of the User.
We may collect information related to the User’s commercial activity within TASK321, including:
a. type of business, categories of services, operating areas, schedules, personnel, technicians, equipment or vehicles;b. customers, leads, prospects, contacts and calendars;c. orders, appointments, quotations, jobs, assignments, cancellations, confirmations and service status;d. prices, quotes, discounts, charges, notes, comments and operational rules;e. performance metrics, productivity, conversions, timing, revenue, activity and utilization of functionalities.

3.5 Information of Customers, Leads and Third Parties Uploaded by the User.
When the User uses the Services to manage their operations, we may process third-party data uploaded, synchronized or generated within the platform, including, without limitation:
a. name, surname, email, telephone number, address or contact information;b. service history, appointments, quotations, messages and preferences;c. internal notes, tags, classifications, reminders or status indicators;d. locations, addresses, service instructions or scheduling data;e. any other information that the User uploads, imports, synchronizes, receives or processes through TASK321 regarding third parties.
Fusion does not guarantee nor verify by default the accuracy, lawfulness, timeliness or legal basis of such information, which remains the responsibility of the User who incorporates it.

3.6 Payment, Billing and Subscription Information.
We may collect or receive information related to payments, subscriptions and collections, including:
a. subscribed plan, renewals, upgrades, downgrades and cancellations;b. invoiced amounts, recurring charges, commissions, variable consumption and credits;c. payment status, due dates, rejected charges, chargebacks, refunds or reversals;d. transaction identifiers, billing references, tokens and confirmations from payment processors;e. partial information received from Stripe, Square or other payment or billing providers.
Fusion does not necessarily store all sensitive financial data directly, and part of such information may be processed by specialized third parties subject to their own policies and terms.

3.7 Technical, Device and Network Information.
We may automatically collect technical information related to access to and use of the Services, including:
a. IP address;b. device identifiers, browser type, operating system and version;c. device type, language, time zone, regional settings and carrier;d. technical logs, errors, crashes, system events and diagnostics;e. network information, connectivity, latency, DNS, cookies, session identifiers and telemetry;f. information about visited pages, screens used, clicks, navigation, interactions and usage time.

3.8 Usage, Metrics and Analytics Information.
We may collect or infer information about how the User uses the Services, including:
a. functionalities used;b. frequency, duration and volume of use;c. activated integrations;d. messages sent, quotations generated, tasks assigned or automations executed;e. consumption of resources, tokens, messages, users, channels or APIs;f. internal metrics, performance, engagement, conversions, funnels, usage rate and behavior within the platform.

3.9 Information from Integrations and Third-Party Services.
If the User connects TASK321 with Third-Party Services, we may receive, synchronize, access or process information from such third parties, including, without limitation:
a. calendar, scheduling or availability data;b. messaging, email, SMS, WhatsApp or telephony data;c. payment, transaction or billing status information;d. map, location, route or geolocation data;e. identity, authentication, electronic signature or verification data;f. content, messages, events, files, metadata or technical results associated with the integration activated by the User.
The amount and type of information received will depend on the configuration chosen by the User, the integration enabled and the capabilities of the corresponding third-party provider.

3.10 Messaging, Voice and Communications Information.
When the User uses communication functions within TASK321 or connects external channels, we may process information related to:
a. emails sent or received through the Services;b. SMS messages, WhatsApp messages, chats, automated messages or scheduled responses;c. calls, telephony events, recordings, voice notes, transcriptions or associated metadata;d. history, delivery status, opening, reading, error, duplication, rejection or non-delivery of communications;e. templates, prompts, sequences, campaigns, automations or suggested responses.

3.11 Information Related to Artificial Intelligence and Automations.
When the User uses artificial intelligence tools, virtual assistants, automations, suggested responses, automated quotations, classification, prioritization or any other automated functionality, we may collect or generate information related to:
a. prompts, instructions, inputs, forms or parameters used;b. responses, drafts, recommendations, classifications, estimates or other generated outputs;c. usage metrics, quality metrics, correction, acceptance or rejection of results;d. information necessary to operate, debug, improve, audit, secure or monitor such functionalities;e. errors, hallucinations, failures, response times, interruptions or events associated with such tools.
The document dated 03-26 already contemplated that artificial intelligence and equivalent services may process data, responses and content, including through external providers.

3.12 Support, Sales, Onboarding and Compliance Information.
We may collect information provided by the User or generated in connection with:
a. meetings, demos, onboarding and activation processes;b. support tickets, chats, emails, calls or contact forms;c. commercial inquiries, negotiations, upgrades, complaints or special requests;d. audits, regulatory requests, verifications, investigations or compliance controls;e. documentation, evidence, screenshots, files or communications related to support or enforcement.

3.13 Information Inferred, Derived or Generated by TASK321.
In addition to information provided directly, Fusion may infer, derive, model, score, group, classify or generate information from the use of the Services, including patterns, metrics, scores, tags, operational estimates, statistics, risk indicators, usage behavior, preferences, status indicators and other derived information reasonably necessary for the operation or evolution of TASK321.

3.14 Aggregated, Anonymized and De-Identified Information.
Fusion may collect, generate or maintain aggregated, anonymized, de-identified, statistical, technical or operational information derived from the use of the Services, provided that such information does not reasonably identify an identified or identifiable natural person. This category may include analytics, usage metrics, trends, patterns, internal benchmarks and other derived information.

3.15 Sources of Information.
Information processed by Fusion may originate from one or more of the following sources:
a. the User itself;b. sub-users, employees, contractors or representatives of the User;c. customers, leads, contacts or third parties incorporated into TASK321;d. devices, browsers, networks and technical environments;e. integrations, APIs and Third-Party Services;f. payment processors and messaging platforms;g. artificial intelligence and automation tools;h. interactions with support, sales, onboarding or compliance;i. technical logs, analytics, telemetry, security and internal operations of Fusion.

3.16 Information We Are Not Required to Verify.
Unless applicable law imposes a specific obligation in a particular case, Fusion shall not be required to independently verify the accuracy, validity, lawfulness, legitimacy, consent, ownership or quality of all information entered or synchronized by the User or by third parties through the Services.

3.17 Sensitive Data and Special Categories of Data.
TASK321 is not designed or generally intended for the collection, processing, storage or use of special categories or sensitive personal data, unless Fusion expressly enables such processing in writing for a specific functionality and under particular applicable conditions.
Without limiting the foregoing, the User shall not upload, synchronize, process or communicate through the Services data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data used to uniquely identify a person, data concerning health, sexual life or sexual orientation, or other categories of information specially protected by applicable legislation, unless:
a. the User has a sufficient and fully valid legal basis to do so;b. such processing is strictly necessary for the User’s activity and compatible with the Services;c. the User has provided the required notices and obtained the necessary consents or authorizations; andd. the User assumes full responsibility for such processing.
Fusion does not assume a general obligation to review, detect, classify or proactively monitor the presence of sensitive data uploaded by the User and shall not be responsible for the processing of such categories of data when they have been incorporated by the User or by third parties under the User’s control without the express authorization of Fusion.

3.18 Data Minimization and Adequacy.
The User shall endeavor to ensure that all information uploaded, imported, synchronized, communicated or processed through TASK321 is adequate, relevant, reasonably accurate and limited to what is necessary for the specific purpose pursued within their operations.
Fusion may design, configure or recommend practices aimed at reducing excessive or unnecessary data processing, but shall not be responsible for the User’s decision to upload, retain, duplicate, synchronize or use excessive, irrelevant, outdated or unnecessary information for the purposes of their business.
Nothing in the Services shall be interpreted as an instruction or recommendation by Fusion to collect more data than reasonably necessary.

4. HOW WE USE INFORMATION


4.1 General Purposes of Use.
Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) may use, process, organize, combine, store, analyze, transmit, share, retain, infer, anonymize or otherwise exploit the information collected in connection with the Services for the purposes described in this Policy and for any other legitimate purpose that is compatible, related to, and reasonably connected with the operation, administration, evolution, protection, monetization, compliance or improvement of TASK321.

4.2 Provision and Operation of the Services.
We may use information to provide, enable, maintain, administer, execute and operate the Services, including, without limitation:
a. creating, authenticating, maintaining and administering user accounts;b. enabling access, permissions, roles, configurations and internal hierarchies;c. processing, storing, displaying, synchronizing, organizing and managing data, messages, schedules, customers, jobs, quotations, payments, automations and integrations;d. facilitating the use of functionalities, modules, APIs, integrations and tools within TASK321;e. providing the technical infrastructure necessary for the operation of the Services.

4.3 Commercial and Contractual Administration.
We may use information to administer the commercial and contractual relationship with the User, including:
a. account registration and activation of services;b. management of plans, subscriptions, upgrades, downgrades, renewals and cancellations;c. billing, collections, commissions, variable charges, refunds, chargebacks, reversals and recovery of credits;d. verification of commercial identity, prevention of financial fraud and compliance controls;e. sending contractual, operational, legal or commercial communications related to the account.

4.4 Support, Assistance and Onboarding.
We may use information to assist the User before, during and after the contracting or use of the Services, including:
a. responding to inquiries, complaints, tickets and requests;b. providing onboarding, training, operational assistance and technical support;c. investigating errors, incidents, outages, failures, complaints or usage issues;d. documenting interactions related to support, sales, account management and compliance;e. improving service, retention and user satisfaction processes.

4.5 Security, Integrity and Risk Prevention.
We may use information to protect TASK321, its users, third parties and associated infrastructure, including:
a. authenticating access and detecting suspicious activity;b. preventing fraud, abuse, misuse, unauthorized access, scraping, bots, attacks or security incidents;c. monitoring technical and operational behavior within the platform;d. applying preventive, corrective or restrictive measures in response to legal, technical, financial, reputational or regulatory risks;e. preserving evidence, logs, traces, technical records and metadata for enforcement, audit, security or legal defense purposes.

4.6 Legal, Regulatory and Contractual Compliance.
We may use information to comply with legal, regulatory, judicial, tax, accounting, contractual or compliance obligations, including:
a. responding to requests from authorities, courts, regulators or auditors;b. complying with obligations relating to retention, reporting, investigation, cooperation or documentation;c. enforcing these Terms, the Privacy Policy and other applicable agreements;d. investigating breaches, claims, disputes, chargebacks, sanctions or controversies;e. protecting the rights, property, reputation, operations and legitimate interests of Fusion.

4.7 Improvement, Development and Evolution of the Services.
We may use information to design, improve, correct, optimize, develop, train, test, adapt, expand or discontinue functionalities, products, workflows, integrations and components of TASK321, including:
a. analysis of performance, usage, engagement, metrics and behavioral patterns;b. identification of errors, bottlenecks, bugs, technical limitations or usage patterns;c. improvement of user experience, navigation, stability, scalability and performance;d. design or training of automations, operational logic, internal processes and tools based on artificial intelligence;e. development of new products, modules, service categories, business models or future functionalities.

4.8 Artificial Intelligence, Automations and Models.
We may use information, prompts, instructions, inputs, outputs, responses, metrics, usage patterns, corrected or rejected results and any other information associated with artificial intelligence tools, automation or non-human processing in order to:
a. operate functionalities based on artificial intelligence or automation;b. generate responses, classifications, recommendations, quotations, tags, drafts, summaries, workflows or other outputs;c. monitor quality, errors, bias, response times, consistency and performance;d. debug, audit, adjust, optimize or improve such functionalities;e. develop, train, adapt or evaluate models, rules, logic, prompts, parameters, automations or similar technologies, always in accordance with this Policy, applicable agreements and applicable law.

4.9 Messaging, Voice and Communications.
We may use information to operate, enable, administer, record, optimize and monitor communications sent or received through TASK321 or its integrations, including:
a. emails, SMS, WhatsApp messages, chats, calls, automated messages, reminders and confirmations;b. templates, sequences, campaigns, suggested responses, automated communications and transactional messages;c. metadata related to sending, receipt, reading, errors, duplication, non-delivery, rejection or blocking;d. transcriptions, recordings, notes, telephony or voice events, where such functionalities are enabled;e. quality control, troubleshooting, compliance and abuse prevention.

4.10 Integrations and Third-Party Services.
We may use information to enable, sustain, administer, synchronize, protect and manage integrations with Third-Party Services, including:
a. payment processors;b. calendars, scheduling tools, maps, geolocation and routing services;c. messaging, email, telephony, voice or social channels;d. electronic signature tools, identity verification, authentication, biometrics or documentation services;e. cloud services, storage, analytics, artificial intelligence platforms, marketplaces and other platforms connected with TASK321.

4.11 Analytics, Metrics and Derived Data.
We may use information to generate reports, metrics, statistics, scores, inferences, internal benchmarks, operational analytics, commercial intelligence, usage reports and other derived data that allow us to understand how the Services are used, improve internal decision-making, adjust the product and sustain the commercial model of TASK321.

4.12 Personalization and Configuration.
We may use information to personalize the experience within the Services, including:
a. language, preferences, templates, views and configurations;b. operational recommendations or functional suggestions;c. prioritization of functionalities, modules, automations or integrations;d. adaptation of the account to the User’s profile, industry or usage patterns.

4.13 Marketing, Promotion and Commercial Growth.
We may use information, to the extent permitted by applicable law, for marketing, remarketing, promotion, sales, commercial communications, demand generation, informational campaigns, user activation, retention, referrals, commercial research and market analysis, including segmentation and performance measurement.
Where applicable law requires consent for certain communications or activities, Fusion shall comply with the mechanisms and requirements imposed by such legislation.

4.14 Aggregated, Anonymized and De-Identified Data.
We may use, retain, analyze, disclose, license, commercialize, exploit or share aggregated, anonymized, de-identified, statistical, technical, operational or derived data, provided that such data does not reasonably identify an identified or identifiable natural person. This includes usage metrics, trends, comparisons, patterns, internal benchmarks, performance indicators and analytical results.

4.15 Defense of Fusion’s Rights and Interests.
We may use information when necessary or convenient to exercise rights, defend claims, enforce contracts, recover credits, preserve evidence, investigate incidents, respond to allegations, limit risks or protect the legal, commercial, technical, operational or reputational interests of Fusion.

4.16 Compatibility and Related Purposes.
The User acknowledges and agrees that Fusion may use information for any additional purpose that is reasonably compatible, related, derived from or necessary with respect to the purposes expressly described in this Policy, provided that such use is not incompatible with applicable law or with the limitations expressly assumed by Fusion.

4.17 No Obligation to Restrict Use to the Minimum Literal Interpretation.
Nothing in this Policy shall be interpreted as limiting Fusion exclusively to literal, narrow or isolated uses of information when a broader, complementary, operational or technically necessary use is reasonably connected with the provision, improvement, monetization, administration, security or compliance of the Services.

5. LEGAL BASES AND GROUNDS FOR PROCESSING


5.1 General Legal Bases for Processing.
Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) shall process personal information and other information regulated under this Policy based on one or more applicable legal or lawful grounds depending on the nature of the data, the purpose of the processing, the relationship with the User, the applicable jurisdiction and the context in which the information is collected or used.
Such grounds may include, without limitation:
a. the performance of a contract or the implementation of pre-contractual measures requested by the User;b. compliance with legal, regulatory, judicial, tax, accounting or compliance obligations;c. the legitimate interests of Fusion or third parties, where such interests are not overridden by rights or freedoms that require stronger protection;d. the consent of the User or the relevant individual, where such consent is required by applicable law or appropriate considering the nature of the processing;e. protection against fraud, abuse, security incidents, claims, contractual breaches or operational, legal, reputational or financial risks;f. any other legal basis permitted or recognized by applicable law.

5.2 Performance of a Contract or Pre-Contractual Measures.
Fusion may process information where such processing is necessary to enter into, execute, administer, maintain, renew, modify, suspend or terminate the contractual relationship with the User, or to implement pre-contractual measures requested by the User, including, without limitation:
a. registering accounts, activating services and administering access;b. configuring functionalities, integrations, permissions and plans;c. providing support, onboarding, technical support and assistance to the User;d. processing payments, subscriptions, renewals, upgrades, downgrades and cancellations;e. providing operational functionalities, messaging services, automation tools, payment features, artificial intelligence tools, scheduling tools, commercial management features or any other component contracted or activated within TASK321.

5.3 Compliance with Legal Obligations.
Fusion may process information when necessary to comply with obligations imposed by laws, regulations, judicial orders, requests from authorities, tax or accounting rules, regulatory requirements, telecommunications laws, data protection laws, security obligations, fraud prevention obligations, evidentiary retention obligations or any other applicable legal requirement.
This includes, without limitation:
a. responding to administrative, judicial or regulatory requests;b. complying with reporting, retention, audit or documentation obligations;c. addressing data subject rights where applicable;d. preserving records necessary for investigations, claims, audits or enforcement.

5.4 Legitimate Interests of Fusion.
Fusion may process information where such processing is reasonably necessary to pursue its legitimate interests, including commercial, operational, technical, security, contractual or strategic interests, provided that such interests are not overridden by rights or freedoms that, under applicable law, require stronger protection.
Such legitimate interests may include, without limitation:
a. operating, protecting, maintaining, monitoring and improving the Services;b. preventing fraud, abuse, unauthorized access, scraping, bots, misuse or security incidents;c. conducting audits, verifications, usage analysis, troubleshooting, quality control and internal analytics;d. developing, testing, adjusting, optimizing or evolving functionalities, integrations, automations, models and tools;e. defending rights, preserving evidence, investigating breaches and enforcing contracts;f. managing legal, regulatory, technical, commercial, reputational or financial risks;g. personalizing, optimizing and adapting the user experience;h. promoting, measuring and sustaining the commercial growth of TASK321, to the extent permitted by law.

5.5 Consent.
Fusion may process information based on consent where:
a. applicable law requires it;b. the nature of the processing, channel or jurisdiction makes obtaining consent advisable;c. the User voluntarily activates functionalities that involve specific processing;d. consent is required for certain promotional communications, cookies, tracking tools, messaging channels or sensitive features.
Where processing is based on consent, such consent may be obtained through electronic means, including click-wrap agreements, tap-wrap confirmations, activation of functionalities, configuration settings, opt-in mechanisms, in-app acceptance or any other legally valid mechanism under applicable law.

5.6 Consents Obtained by the User.
Where the User uses the Services to upload, process, synchronize or communicate third-party data, the User shall be responsible for obtaining and maintaining any consents, notices, permissions or legal bases required with respect to those third parties.
Fusion shall not be responsible for the absence, invalidity, insufficiency or withdrawal of consents that should have been obtained by the User from clients, leads, employees, contractors, contacts or other third parties whose data is incorporated into TASK321 for the purposes of the User’s business.

5.7 Fraud Prevention, Security and Compliance.
Fusion may process information where necessary to detect, prevent, mitigate, investigate or respond to fraud, unlawful activities, system abuse, contractual breaches, security incidents, attacks, claims, chargebacks, compliance risks, regulatory risks or any other situation that may affect Fusion, the Services, the User or third parties.

5.8 Communications and Operation of the Service.
Fusion may process information to send operational, transactional, contractual, legal, support, security, billing or maintenance communications where such processing is necessary for the provision of the Services, the management of the account or the administration of the relationship with the User.
Processing related to such communications shall not necessarily depend on promotional consent where those communications are necessary for the operation or administration of the service.

5.9 Artificial Intelligence, Automations and Service Improvement.
Fusion may process information related to artificial intelligence, automations, prompts, inputs, outputs, messages, classifications, recommendations, metrics and other related elements where such processing is necessary to:
a. operate functionalities enabled by the User;b. monitor performance, errors, inconsistencies or bias;c. debug, correct, improve, adjust, train, test or develop such functionalities;d. protect the integrity, security, reliability and operational usefulness of the system.
Such processing may be based, as applicable, on the performance of the contract, the legitimate interests of Fusion or any other lawful basis permitted by applicable law and appropriate to the nature of the functionality used.

5.10 Aggregated, Anonymized and De-Identified Data.
Fusion may use aggregated, anonymized, de-identified, statistical, technical or operational data based on its legitimate interests, the performance of the service or any other lawful basis compatible with applicable law, provided that such data does not reasonably identify an identified or identifiable natural person.

5.11 Jurisdictional Variations.
The User acknowledges that the specific legal basis applicable to a particular processing activity may vary depending on the jurisdiction, the category of the data, the purpose pursued, the relationship between the parties, the configuration of the Service or the specific applicable regulatory framework.
Fusion may rely on one or more legal bases simultaneously with respect to the same processing activity where such reliance is legally valid and operationally reasonable.

5.12 Reservation of Compatible Legal Grounds.
Nothing in this Policy shall be interpreted as limiting Fusion exclusively to a single legal basis or rigid legal ground for a given processing activity. Fusion may invoke, apply or document any additional, complementary or compatible legal basis that is valid under applicable law, even if not exhaustively identified in this Section.
5.13. Third-Party Liability. 
While Fusion vets its sub-processors for high security standards, Fusion shall not be held liable for security breaches or data loss occurring within the infrastructure of third-party providers (such as cloud hosting providers, payment gateways, or AI engine providers) beyond the extent of Fusion's direct negligence.


6. SHARING OF INFORMATION WITH THIRD PARTIES, PROVIDERS AND SUBPROCESSORS


6.1 General Principle.
Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) may share, disclose, transmit, make available, synchronize, host, transfer or permit access to information processed in connection with the Services where such action is necessary, appropriate or reasonably related to the operation, provision, protection, administration, monetization, evolution, compliance or defense of TASK321, in accordance with this Policy, applicable agreements and applicable law.

6.2 Categories of Recipients.
Fusion may share information with one or more of the following categories of recipients, as applicable:
a. affiliates, parent companies, subsidiaries, entities under common control, successors, assignees or entities associated with Fusion;b. infrastructure, hosting, cloud, storage, CDN, monitoring, observability, backup, technical support, debugging, security, logging or analytics providers;c. payment processors, billing platforms, subscription management services, collection services, antifraud systems, risk management providers and financial service providers;d. messaging providers, email providers, SMS providers, WhatsApp services, voice and telephony services, recording services, transcription services, campaign management tools, sequences or automated communication services;e. artificial intelligence providers, machine learning platforms, classification systems, automation services, virtual assistants, content generation tools, automated analysis technologies or equivalent technologies;f. authentication, identity verification, biometric verification, document verification, electronic signature, compliance and security service providers;g. providers of calendars, scheduling systems, maps, geolocation services, routing services, marketplaces, CRM systems, APIs, connectors, integrations, webhooks or complementary platforms;h. legal advisors, accountants, auditors, consultants, experts, compliance service providers, investigators, forensic specialists or collection agencies;i. administrative, judicial, regulatory, tax, law enforcement authorities or any third party where necessary to comply with legal obligations or defend rights;j. third parties involved in corporate transactions, reorganizations, mergers, acquisitions, financing, asset sales, due diligence processes or assignments;k. any other provider, contractor or subprocessor whose involvement is reasonably necessary for the purposes described in this Policy.

6.3 Purposes of Sharing.
Information may be shared with third parties for, among other purposes:
a. providing and operating the Services;b. enabling integrations, APIs and functionalities activated by the User;c. processing payments, subscriptions, charges, chargebacks or billing;d. sending messages, notifications, campaigns, automated responses or operational communications;e. operating or improving artificial intelligence, automation, classification or analytical functions;f. protecting the security, integrity and availability of the Services;g. monitoring performance, stability, errors, incidents, fraud or abuse;h. complying with regulatory, judicial, accounting, tax or contractual requirements;i. conducting audits, verifications, investigations, due diligence processes or legal defense;j. sustaining, scaling, monetizing, improving or evolving the business model and infrastructure of TASK321.

6.4 Subprocessors and Service Providers.
Fusion may engage subprocessors, data processors, service providers, specialized contractors or functionally equivalent third parties to process information on its behalf or for purposes necessary to operate the Services.
Such third parties may access, host, process, store, transform, transmit, protect, classify, analyze or delete information to the extent necessary to perform services for Fusion.
Fusion may select, replace, add or remove subprocessors or providers at any time in accordance with its operational, commercial, technical, regulatory or security needs.

6.5 Integrations Activated by the User.
When the User connects, enables, authorizes or uses an integration with a Third-Party Service, Fusion may share with such third party the information, content, messages, files, configurations, metadata, events, prompts, outputs, contacts, calendars, payments or any other information reasonably necessary to operate the integration requested by the User.
The User acknowledges that such sharing may involve additional processing by the third party, subject to that third party’s own terms, privacy policies, rules of use, security standards and operational decisions.

6.6 Artificial Intelligence and Automation Services.
When the User utilizes tools based on artificial intelligence, virtual assistants, automations or automated analytical processes, Fusion may share information with artificial intelligence providers, models, APIs, classification engines or equivalent platforms to enable the operation, adjustment, security, debugging, improvement, support, monitoring or evaluation of such tools.
This may include prompts, inputs, messages, content, files, parameters, instructions, outputs, classifications, corrected or rejected results, usage metadata, errors, response times and other information necessary for the operation or improvement of the service.

6.7 Payments, Billing and Financial Processing.
Fusion may share information with Stripe, Square or other payment processors, subscription services, financial compliance tools or antifraud systems in order to:
a. process subscriptions, payments, charges and commissions;b. verify identity, risk, compliance or fraud indicators;c. manage chargebacks, refunds, reversals or payment blocks;d. maintain traceability of transactions, references, receipts and reconciliations.
Fusion does not fully control the processing performed by such third parties under their own terms and policies, and the User acknowledges that part of the financial information will be processed directly by them.

6.8 Messaging, Telephony and Communications.
Fusion may share information with providers of email, SMS, WhatsApp, telephony, voice services, recording services, transcription services, campaign management tools or automated communication systems in order to send, route, record, monitor, debug, verify, deliver or analyze communications related to the Services or the User’s use of them.
This may include recipients, message content, templates, sending schedules, delivery status, errors, rejections, recordings, transcriptions, call events and associated metadata.

6.9 Legal Compliance, Protection and Defense.
Fusion may share information when it reasonably believes in good faith that doing so is necessary or appropriate to:
a. comply with legal, regulatory, tax, accounting or judicial obligations;b. respond to requests from authorities or formal legal processes;c. investigate fraud, abuse, security incidents, contractual violations or third-party claims;d. exercise, protect or defend the rights, intellectual property, operations, reputation or legitimate interests of Fusion;e. preserve evidence, records, logs, metadata or relevant information for disputes, investigations or proceedings.

6.10 Corporate Transactions and Restructuring.
Fusion may share or transfer information in connection with mergers, acquisitions, asset sales, reorganizations, financing transactions, changes of control, assignments, due diligence processes, corporate restructurings or similar transactions.
In such cases, the information may form part of the assets, systems, databases, contracts or documentation evaluated, shared or transferred, subject to confidentiality obligations and applicable legal requirements.

6.11 Aggregated, Anonymized and De-Identified Data.
Fusion may share, disclose, license, commercialize or otherwise exploit with third parties aggregated, anonymized, de-identified, statistical, technical, operational or analytical data, provided that such data does not reasonably identify an identified or identifiable natural person.

6.12 No Sale of Personal Data in the Strict Sense, Except Where Permitted by Applicable Law.
Unless expressly indicated otherwise in this Policy, in a specific notice, or where applicable legislation uses a broader definition of “sale”, “sharing” or “targeted advertising” that encompasses certain data exchanges, Fusion does not commercialize identifiable personal data as an independent database unrelated to the provision, monetization, improvement or growth of its Services.
Notwithstanding the foregoing, the User acknowledges that certain exchanges of information with third parties for analytics, marketing, remarketing, attribution, personalization, measurement or commercial growth purposes may be considered by some laws as “sharing”, “selling” or equivalent regulatory categories, in which case Fusion shall act in accordance with the mechanisms and notices required by the applicable regulations.

6.13 Lack of Full Control Over Third Parties.
The User acknowledges that once information is shared with an authorized third party pursuant to this Policy or through an integration activated by the User, Fusion does not fully control the practices, decisions, security measures, retention policies, availability or internal policies of such third party, except to the extent governed by a specific contractual relationship.

6.14 User Responsibility for Third-Party Data.
Where the information shared derives from data relating to customers, leads, contacts, employees, contractors or other third parties uploaded by the User, the User shall remain responsible for ensuring that sufficient consents, permissions, notices and legal bases exist for the collection, use, integration, automation, messaging and sharing of such information within TASK321 and with the third parties associated with the service.

6.15 Changes to Providers and Subprocessors.
Fusion may modify, replace, add, remove or consolidate providers, subprocessors, APIs, platforms or other third parties involved in information processing at any time when reasonably necessary for technical, commercial, regulatory, operational, security, availability, cost or service evolution reasons.

6.16 Broad and Functional Interpretation.
This Section shall be interpreted broadly in order to allow Fusion to share information to the extent reasonably necessary to operate, protect, sustain, improve, monetize and enforce the Services, even where a category of provider, technology or integration is not described under a specific commercial name in this Policy.
6.17. Consent to Automated Communications. 
By providing a phone number, the User expressly consents to receive communications from Fusion via SMS, WhatsApp, and voice calls, including those generated through automated telephone dialing systems or artificial intelligence, for operational, security, and marketing purposes. The User acknowledges that providing this consent is not a condition of purchasing any property, goods, or services, and may opt-out at any time by replying "STOP" or by contacting support.


7. ARTIFICIAL INTELLIGENCE, MESSAGING, APIs AND AUTOMATED INTEGRATIONS


7.1 Scope of this Section.
Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) may offer, integrate, enable, support, depend on or make available to the User functionalities related to artificial intelligence, machine learning, virtual assistants, suggested responses, automations, automated classification, automated quotations, task assignment, messaging, email, SMS, WhatsApp, telephony, voice, recording, transcription, APIs, webhooks, bots, connectors and other present or future technological tools (collectively, the “Automated Functionalities”).

7.2 Dependence on Third Parties and External Systems.
The Automated Functionalities may depend in whole or in part on providers, APIs, platforms, models, engines, messaging services, telecommunications operators, cloud systems, artificial intelligence services or other third parties independent from Fusion.
The User acknowledges and agrees that Fusion does not fully control such third parties, their models, their APIs, their response times, their changes, their outages, their limitations, their filters, their policies, their blocks, their pricing, their rules of use or their technical or operational decisions.

7.3 Data Processed by Automated Functionalities.
Fusion may collect, receive, access, process, transmit, transform, store, record, classify, analyze, synchronize or share with third parties information related to the Automated Functionalities, including, without limitation:
a. prompts, inputs, instructions, forms, parameters and configurations;b. messages, emails, SMS, WhatsApp messages, responses, notes, audio files, recordings, transcriptions and related communications;c. outputs, classifications, suggestions, estimates, quotations, drafts, tags, priorities, recommendations and generated responses;d. metadata related to sending, receiving, reading, errors, delays, duplication, rejection, blocking, non-delivery or lack of response;e. technical logs, metrics, response times, events, telemetry, traces, validations and monitoring data;f. data relating to contacts, customers, leads, third parties, calendars, schedules, addresses, tasks, appointments, tickets, payments or any other information necessary to operate the functionality enabled by the User.

7.4 Purposes of Processing.
Fusion may process information related to the Automated Functionalities in order to:
a. operate, execute, route, enable, support and maintain such functionalities;b. generate responses, drafts, messages, quotations, automations, classifications or recommendations;c. monitor performance, errors, response times, stability, bias, quality and consistency;d. debug, correct, test, audit, improve, adjust, train or develop such functionalities;e. protect the security, integrity, reliability and operational usefulness of TASK321;f. comply with legal, regulatory, contractual, audit, compliance or evidentiary preservation obligations;g. manage costs, usage, limits, logs, traceability, performance and scalability of the service.

7.5 No Guarantee of Accuracy or Result.
Fusion does not guarantee that the Automated Functionalities will produce results that are accurate, complete, consistent, current, appropriate, lawful, useful, free of bias, free of errors or suitable for any specific situation.
The User acknowledges that responses, outputs, classifications, recommendations, messages, quotations, estimates, assignments, transcriptions or automations may contain errors, omissions, hallucinations, ambiguities, results out of context, delays, duplications, incorrect interpretations, incomplete data, inconsistencies or inappropriate content.

7.6 Supervision and Responsibility of the User.
The User shall be solely responsible for reviewing, validating, approving, supervising and assuming the consequences of any message, response, quotation, classification, assignment, automation, AI output or communication generated, suggested, executed or assisted by the Automated Functionalities before relying on it or using it with clients, leads, employees, contractors or third parties.
Fusion shall not be responsible for commercial, operational, legal, financial, reputational or technical decisions taken by the User or by third parties based on outputs, messages or automations related to these functionalities.

7.7 Messaging and Telecommunications.
Where the User uses Automated Functionalities to send messages or communications through email, SMS, WhatsApp, voice, telephony or other channels, Fusion may process the information necessary to execute, monitor, record, transcribe, route, verify, debug or analyze such communications.
The User acknowledges that:
a. delivery, receipt, reading, listening, transcription, prioritization or availability of the communication channel is not guaranteed;b. messages may be delayed, lost, blocked, duplicated, rejected, limited or not delivered;c. the operation of the communication channel may depend on third parties, APIs, messaging platforms, telecommunications operators or external policies;d. the User shall be solely responsible for obtaining and maintaining sufficient consents, permissions, notices and legal bases to send messages or communications to third parties;e. the User shall be solely responsible for any claim, fine, investigation, blocking, sanction or dispute related to communications sent through the Services.

7.8 APIs, Webhooks and Technical Integrations.
Fusion may process and share information through APIs, webhooks, connectors, integrations, SDKs, endpoints, third-party services or equivalent mechanisms to enable the functioning of TASK321 and the Automated Functionalities.
The User acknowledges that such integrations may:
a. change without prior notice;b. cease to function;c. be limited, suspended or discontinued by third parties;d. generate errors, delays, incomplete data, inconsistencies or synchronization failures;e. involve additional information processing by third parties.

7.9 Future Technological Changes.
This Policy shall apply not only to the Automated Functionalities currently available, but also to any future technology, equivalent technology, replacement technology or functionally similar technology that Fusion may incorporate into TASK321, including new artificial intelligence tools, messaging channels, telephony systems, voice tools, transcription systems, automation systems, classification tools, verification systems, biometric technologies, electronic signature technologies, analytics systems, orchestration tools or integrations.

7.10 Artificial Intelligence Providers and External Models.
Fusion may use proprietary models, open-source models, licensed models or models provided by third parties, including large language models, classification engines, recommendation systems, automated analysis tools or equivalent technologies, and may transmit or receive information necessary to operate such models to the extent reasonably required for the provision, monitoring, debugging, improvement or evolution of the service.

7.11 Retention and Evidence.
Fusion may retain prompts, inputs, outputs, messages, metadata, logs, configurations, transcriptions, recordings, suggested responses, error events, metrics and other digital evidence related to the Automated Functionalities for as long as reasonably necessary for support, security, auditing, legal defense, compliance, investigation, product improvement, quality control or evidentiary preservation.

7.12 No Restrictive Interpretation.
This Section shall be interpreted broadly to cover any processing of information reasonably related to artificial intelligence, automation, messaging, APIs, telephony, voice, recording, transcription, classification or equivalent technologies used by TASK321, even if a specific technology, provider, channel or integration is not expressly identified in this Policy.

7.13. Ownership of Outputs and Responsibility. 
The User is the sole owner of the data inputs and, to the extent permitted by applicable law, the results generated (Outputs) by the Platform's AI tools. However, due to the nature of machine learning systems, Fusion does not guarantee that the outputs will be unique to each user. The User assumes full responsibility for verifying the accuracy, quality, and legality of the outputs before professional or commercial use, holding Fusion harmless from any claims of third-party intellectual property infringement arising from the use of such outputs.

8. PAYMENTS, BILLING, SUBSCRIPTIONS AND COLLECTIONS


8.1 Scope.
Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) may collect, receive, access, process, record, store, transmit, verify, reconcile, retain and use information related to payments, subscriptions, collections, charges, commissions, billing, chargebacks, refunds, renewals, usage and any other financial transaction associated with the Services.

8.2 Types of Financial Information Processed.
Information processed in connection with payments and billing may include, without limitation:
a. subscribed plan, renewals, upgrades, downgrades, cancellations and expiration dates;b. invoiced amounts, recurring charges, variable charges, commissions, usage-based costs, credits, discounts or adjustments;c. payment status, rejected payments, pending payments, held funds, refunds, chargebacks, reversals, reconciliations and claims;d. transaction identifiers, references, tokens, internal account numbers, vouchers, receipts, invoices and collection records;e. partial or limited information provided by payment processors, financial platforms, issuers, acquirers, banks, gateways or other parties involved in the transaction;f. information related to identity verification, fraud detection, risk assessment, financial compliance, abuse prevention or regulatory controls.

8.3 Payment Processors and Financial Third Parties.
Fusion may use Stripe, Square or other payment processors, gateways, subscription management platforms, antifraud providers, billing services, compliance tools or equivalent third parties to process charges, administer subscriptions, verify identity, prevent fraud or sustain the economic operation of TASK321.
The User acknowledges that part of the financial information will be processed directly by such third parties in accordance with their own terms, privacy policies, operational practices, internal controls and regulatory requirements.

8.4 No Full Control Over Financial Third Parties.
Fusion does not fully control the decisions, policies, reviews, retentions, blocks, reserves, limitations, investigations, validations, rejections, suspensions, delays or criteria applied by payment processors, banks, issuers, acquirers or financial third parties.
Accordingly, Fusion does not guarantee:
a. approval of transactions;b. continuous availability of a particular processor;c. absence of chargebacks, chargebacks or blocks;d. immediate release of funds;e. continuity of costs, commissions or commercial conditions imposed by third parties.

8.5 Purposes of Processing.
Fusion may use information related to payments and billing to:
a. activate, maintain, renew, modify, limit, suspend or cancel plans and subscriptions;b. process charges, collections, commissions, usage charges and billing;c. verify eligibility, risk, fraud or financial compliance;d. administer chargebacks, claims, refunds, reimbursements, adjustments, credits and reconciliations;e. generate receipts, traceability records, reports and accounting, contractual or operational records;f. protect collection rights, recover debts or enforce payment obligations;g. comply with legal, tax, regulatory, accounting, banking or compliance requirements.

8.6 Subscriptions, Renewals and Recurring Charges.
When the User subscribes to a recurring plan, the User authorizes Fusion and its payment providers to process periodic charges, automatic renewals, plan updates, usage-based charges, commissions, third-party costs and any other applicable charges in accordance with the Terms and Conditions, the subscribed plan or the configuration selected by the User.

8.7 Payment Method Information.
Fusion may receive, store or process limited information related to payment methods to the extent necessary to administer the account, validate transactions, maintain subscriptions, detect fraud, reconcile payments or retain billing records. Notwithstanding the foregoing, sensitive financial information may be primarily processed, tokenized or stored by specialized third parties rather than directly by Fusion.

8.8 Chargebacks, Reversals, Claims and Fraud.
Fusion may use and share information with processors, banks, issuers, card networks, advisors, collection agencies, authorities or other relevant parties in order to investigate, manage, dispute, defend or respond to chargebacks, reversals, fraud, misuse of payment methods, financial claims, chargebacks or any controversy related to transactions associated with the Services.

8.9 Costs, Commissions and Third-Party Charges.
The User acknowledges that the use of TASK321 may involve costs, commissions, fees, variable charges, messaging costs, token costs, automation costs, financial third-party charges, per-transaction fees, API costs or other amounts associated with the operation of the Services.
Fusion may reflect, pass through, allocate, invoice, deduct or charge such amounts where applicable in accordance with the subscribed plan, the activated configuration, the Terms and Conditions or the operational relationship between the parties.

8.10 Retention of Financial Records.
Fusion may retain records, receipts, references, logs, events, invoices, billing data, payment histories, subscription traces, acceptance evidence, supporting documentation and any other information related to payments and collections for as long as reasonably necessary for operational, accounting, tax, regulatory, contractual, audit, legal defense, compliance or debt recovery purposes.

8.11 No Assumption of Banking or Fiduciary Role.
Nothing in this Policy shall be interpreted as an assumption by Fusion of the role of a bank, financial institution, issuer, acquirer, merchant of record, fiduciary, escrow agent or custodian of funds, except to the extent that applicable law or a specific agreement expressly provides otherwise in a particular case.

8.12 International Transfers and Processing.
The User acknowledges that information related to payments, billing and transactions may be processed, hosted, transmitted or verified by third parties located in different jurisdictions in accordance with the operational structure of financial providers or their subprocessors.

8.13 Broad and Functional Interpretation.
This Section shall be interpreted broadly to cover any processing of information reasonably related to subscriptions, collections, payments, commissions, billing, validations, fraud, reconciliation, recovery, disputes or financial services associated with TASK321, even where a specific technology, provider, payment method or workflow is not expressly identified in this Policy.

9. COOKIES, TRACKING TECHNOLOGIES AND ANALYTICS


9.1 Use of Tracking Technologies.
Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) may use cookies, pixels, tags, SDKs, device identifiers, scripts, local storage, session storage, beacons, fingerprints, logs, tokens, tracking technologies, analytics tools and technically equivalent or functionally similar mechanisms (collectively, the “Tracking Technologies”) in connection with its websites, applications, platforms, APIs, integrations, campaigns, communications and Services.

9.2 Purposes.
Tracking Technologies may be used for one or more of the following purposes:
a. operating and enabling essential functionalities of the Services;b. authenticating users, maintaining sessions and administering accounts;c. remembering configurations, language, preferences, views and selected options;d. measuring traffic, performance, navigation, stability, conversions, engagement, funnels and usage of functionalities;e. detecting errors, incidents, fraud, abuse, bots, scraping, anomalies or security risks;f. personalizing the experience, optimizing interfaces and improving the technical and commercial performance of TASK321;g. enabling marketing campaigns, remarketing, attribution, segmentation, advertising measurement, commercial activation or advertising analytics, to the extent permitted by applicable law;h. generating metrics, statistics, reports, operational analytics, internal benchmarks and derived data.

9.3 Types of Technologies.
Tracking Technologies may include, among others:
a. strictly necessary or essential cookies;b. functional or preference cookies;c. performance or analytics cookies;d. advertising, remarketing or measurement cookies or identifiers;e. persistent or temporary browser, device, session or installation identifiers;f. third-party tools for analytics, attribution, marketing, fraud prevention, observability or security;g. any other present or future technology capable of recognizing devices, sessions, navigation, activity or interactions.

9.4 Third-Party Providers.
Fusion may use Tracking Technologies owned by Fusion or by third parties, including providers of analytics, marketing, observability, infrastructure, personalization, security, attribution, advertising or measurement. Such third parties may collect or receive technical information, navigation information, identifiers, events, interactions, session data and other metadata according to their own policies, to the extent permitted by this Policy and by applicable law.

9.5 Information Collected by Tracking Technologies.
Tracking Technologies may collect or generate, among others, the following types of information:
a. IP address;b. device, browser, session or installation identifiers;c. device type, operating system, version, language and time zone;d. pages visited, screens used, clicks, scrolls, events, sessions and usage time;e. traffic source, campaigns, referrals, openings, conversions and browsing behavior;f. errors, crashes, response times, latency, telemetry, logs and technical events;g. data related to fraud, abuse, authentication, risk or security.

9.6 Legal Basis and Consent.
Where applicable law requires consent for the use of certain Tracking Technologies, Fusion may request such consent through banners, pop-ups, preference centers, browser settings, opt-ins or other technically valid mechanisms.
Where applicable law does not require consent or permits the use of certain technologies under another valid legal basis, Fusion may use them in accordance with such basis and this Policy.

9.7 User Management.
The User may, to the extent technically possible and legally required:
a. configure their browser or device to block or delete certain cookies or similar technologies;b. use preference management tools when Fusion makes them available;c. disable certain tracking or marketing functionalities subject to consent.
Notwithstanding the foregoing, blocking, rejecting or deleting Tracking Technologies may affect the availability, security, performance, personalization, functionality or user experience of TASK321.

9.8 No Guarantee of Total Exclusion.
Fusion does not guarantee that disabling certain Tracking Technologies will completely eliminate all technical or analytical data collection associated with the operation, security, integrity, monitoring, compliance or essential functioning of the Services, particularly where certain technologies are necessary for service provision or for legitimate security and administrative purposes.

9.9 Future or Equivalent Technologies.
This Policy shall also apply to future technologies, equivalent technologies, substitute technologies or technologies functionally similar to cookies, pixels, tags, SDKs or tracking mechanisms currently in existence, even if they are not specifically named in this Section.

9.10 Aggregated Data and Derived Analytics.
Fusion may use information collected through Tracking Technologies to generate aggregated, anonymized, de-identified, statistical, technical, operational or internal analytical data, provided that such data does not reasonably identify an identified or identifiable natural person.

9.11 Broad and Functional Interpretation.
This Section shall be interpreted broadly to allow Fusion to use Tracking Technologies to the extent reasonably necessary to operate, protect, improve, measure, monetize and evolve TASK321, even where a specific tool, provider, identifier or technology is not expressly named in this Policy.

10. RETENTION, STORAGE, BLOCKING AND DELETION OF INFORMATION


10.1 General Retention Standard.
Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) may retain information processed in connection with the Services for as long as reasonably necessary to fulfill the purposes described in this Policy and in the Terms and Conditions of the Services, to operate and protect TASK321, to maintain the contractual and commercial relationship with the User, to comply with legal or regulatory obligations, to preserve evidence, to resolve disputes, to exercise rights or to protect the legitimate interests of Fusion.

10.2 Retention Factors.
In determining the applicable retention period for a category of information, Fusion may consider, among others, the following factors:
a. the nature, sensitivity, volume and purpose of the information;b. the operational, technical, contractual or commercial need to retain it;c. legal, regulatory, tax, accounting, judicial, evidentiary or compliance obligations;d. the existence of claims, disputes, chargebacks, audits, investigations or enforcement risks;e. security requirements, fraud prevention, traceability, operational continuity or incident recovery;f. the need to retain backups, logs, historical records, metrics, analytics, digital evidence or aggregated data;g. requests from the User, authorities or third parties where applicable;h. internal retention, backup, archiving or evidentiary preservation policies.

10.3 Retention During the Contractual Relationship.
Fusion may retain information while the User’s account remains active, while there is a contractual, commercial, technical or operational relationship related to the Services, or for as long as reasonably necessary to provide, administer, bill, audit, protect, improve or enforce TASK321.

10.4 Retention After Termination.
Suspension, cancellation, termination or closure of the account shall not require Fusion to immediately delete all information related to the User. Fusion may retain, block, archive, restrict, segment, pseudonymize, anonymize or delete such information to the extent and for the period reasonably necessary to:
a. comply with legal, regulatory, tax, accounting or judicial obligations;b. resolve disputes, claims, audits, chargebacks, investigations or requests;c. preserve evidence, traceability, records, backups, logs, tickets, transactions or histories;d. protect the rights, operations, intellectual property, reputation, infrastructure or legitimate interests of Fusion;e. maintain aggregated, anonymized, de-identified, statistical, technical or operational data;f. complete pending technical, contractual, financial or security processes.

10.5 Backups, Logs and Derived Systems.
Information may remain temporarily in backups, redundant systems, logs, caches, historical files, technical traces, audit environments, monitoring repositories, disaster recovery systems, security records, snapshots or equivalent systems even after having been deleted from active or production environments. Fusion shall not be required to immediately remove all residual or technical presence of the information in such systems when doing so is not reasonably possible, technically necessary or legally required.

10.6 Anonymization, De-identification and Aggregation.
Fusion may retain and use indefinitely, to the extent permitted by applicable law, aggregated, anonymized, de-identified, statistical, technical, operational or derived information, provided that such information does not reasonably identify an identified or identifiable natural person.

10.7 Deletion or Restriction.
Fusion may delete, restrict, block or disable access to information when it considers it reasonably appropriate for technical, operational, legal, security, compliance, efficiency or service administration reasons, without prejudice to specific obligations that may exist under applicable law or particular agreements.

10.8 Deletion Requests.
Where a User or data subject requests the deletion of information, Fusion shall evaluate such request in accordance with applicable legislation, the nature of the information, Fusion’s role with respect to the data, existing retention obligations, the existence of legal bases for retaining it and the need to preserve evidence, security, traceability or legal defense. Fusion may reject, limit, defer or condition a deletion request where a valid basis exists for retaining the information, including legal, regulatory, contractual, technical obligations or reasonable legitimate interests.

10.9 Retention for Security and Fraud Prevention.
Fusion may retain information, even after termination of the Services or following a deletion request, where reasonably necessary to prevent fraud, identify abuse, investigate incidents, enforce restrictions, detect repeated violations, protect system integrity or prevent misuse of TASK321.

10.10 Retention for Payments, Billing and Debt Recovery.
Fusion may retain information related to payments, subscriptions, charges, chargebacks, reconciliations, refunds, debt recovery, collections, financial disputes, compliance verifications or tax and accounting documentation for as long as reasonably necessary for operational, contractual, regulatory or rights-defense purposes.

10.11 Third-Party Information Uploaded by the User.
Where information has been uploaded or controlled by the User for purposes related to the User’s business, Fusion may depend on the instructions, configurations, integrations, technical restrictions or applicable legal role before proceeding with its deletion, blocking or return, without assuming responsibility for decisions that correspond to the User as the primary or independent controller of such data.

10.12 No Obligation of Indefinite Retention or Permanent Recovery.
Unless a mandatory legal provision or a specific agreement provides otherwise, Fusion shall not be required to retain indefinitely, restore at any time, reconstruct, export or maintain accessible all information processed through TASK321, particularly where the account has been suspended, cancelled, terminated or abandoned by the User.

10.13 Changes to Retention Criteria.
Fusion may modify its retention criteria, retention periods, internal policies or practices relating to retention, blocking, backup, anonymization or deletion of information when reasonably necessary for technical, operational, legal, regulatory, commercial or security reasons.

10.14 Broad and Functional Interpretation.
This Section shall be interpreted broadly to allow Fusion to retain, restrict, block, archive, anonymize, aggregate or delete information to the extent reasonably necessary to operate, protect, defend, monetize, audit, scale and enforce TASK321, even where a specific scenario is not literally described in this Policy.



11. INFORMATION SECURITY


11.1 General Principle of Security.
Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) implements reasonable technical, organizational, administrative and operational measures designed to protect information processed in connection with the Services against unauthorized access, improper disclosure, loss, alteration, destruction, misuse or unauthorized processing.
Such measures may include access controls, authentication mechanisms, encryption, monitoring, system segmentation, activity logs, security tools, internal audits, incident response protocols and other reasonable security practices consistent with the nature of the Services and the risks involved.

11.2 Nature of Information Security.
The User acknowledges that no system, network, technological infrastructure or digital service can guarantee absolute security or complete invulnerability against incidents, attacks, vulnerabilities, human errors, technical failures, external events or malicious actions.
Accordingly, Fusion does not guarantee that the Services will be completely free from vulnerabilities, intrusions, unauthorized access, data loss, cyberattacks, interruptions, data corruption, exploitation of software flaws or other security events.

11.3 User Responsibility for Security.
The User shall be responsible for maintaining the security of their access credentials, passwords, tokens, API keys, security configurations, user permissions and any other mechanisms used to access the Services.
The User shall:
a. protect their credentials and not share them with unauthorized third parties;b. use secure passwords and reasonable authentication mechanisms;c. control access by employees, contractors or sub-users;d. close sessions and revoke access when appropriate;e. notify Fusion of any reasonable suspicion of unauthorized access or security incident.
Fusion shall not be responsible for unauthorized access, data breaches or incidents resulting from the User’s negligence in protecting their credentials or access mechanisms.

11.4 Security of Integrations and Third-Party Services.
When the User uses integrations, APIs, connectors, webhooks or third-party services connected to TASK321, part of the processing of information may depend on the security measures implemented by those third parties.
Fusion does not fully control the security practices, internal policies, infrastructure, technical controls or operational decisions of external providers and therefore does not guarantee the security of systems, networks or platforms operated by such third parties.

11.5 Internal Access and Authorized Personnel.
Access to information within Fusion’s systems may be limited to authorized personnel, contractors or providers who require such access to operate, maintain, protect, improve or support the Services.
Fusion may implement internal access controls, monitoring, activity logging, audits and reasonable procedures designed to reduce the risk of improper access or unauthorized use of information.

11.6 Records, Logs and Monitoring.
Fusion may record, store, analyze and retain technical logs, security events, access traces, activity records, system events, telemetry and other operational metadata for the purpose of:
a. detecting anomalies, abuse or security incidents;b. investigating failures, errors or vulnerabilities;c. preventing fraud or unauthorized access;d. protecting the integrity of the technological infrastructure;e. complying with legal or regulatory obligations;f. preserving evidence for audits, investigations or legal defense.

11.7 Response to Security Incidents.
If a security incident is detected that affects or may affect the integrity, availability or confidentiality of information processed within the Services, Fusion may adopt the technical, operational and legal measures it reasonably considers necessary to investigate, mitigate, contain, correct or manage the incident.
Such measures may include temporary suspension of services, blocking of access, limitation of functionalities, forensic analysis, internal or external notifications, cooperation with providers, advisors or authorities and other actions necessary to protect the platform and its users.

11.8 Notification of Incidents.
Where applicable legislation requires notification of security incidents or personal data breaches, Fusion may communicate such incidents to authorities, affected users or third parties in accordance with applicable legal requirements, the nature of the incident and the information available at that time.

11.9 Security of Communications and Networks.
Communications between the User and the Services may be transmitted through public or private networks that are not fully controlled by Fusion. The User acknowledges that such networks may be subject to interruptions, interception, failures or risks inherent to internet or telecommunications infrastructure.

11.10 Limitation of Liability for Security Incidents.
To the extent permitted by applicable law and as established in the Terms and Conditions of the Services, Fusion shall not be liable for damages, losses, claims, interruptions or consequences arising from security incidents caused by:
a. cyberattacks, malware, ransomware, phishing, exploitation of vulnerabilities or other malicious activities by third parties;b. failures in external systems, networks or infrastructures;c. human errors by the User or third parties authorized by the User;d. integrations or third-party services;e. force majeure events or circumstances beyond the reasonable control of Fusion.

11.11 User Cooperation.
The User agrees to reasonably cooperate with Fusion in the investigation, mitigation or resolution of security incidents involving the User’s account, integrations, users or data when such cooperation is necessary to protect the integrity of the Services or other users.

11.12 Continuous Security Improvement.
Fusion may update, modify, reinforce, replace or improve its security practices, controls, technologies, protocols and security policies when it reasonably considers it necessary to adapt to new threats, technologies, regulatory requirements or operational needs.

11.13 Broad and Functional Interpretation.
This Section shall be interpreted broadly to allow Fusion to implement, modify or expand reasonable security measures intended to protect the Services, technological infrastructure, processed information and the legitimate interests of Fusion and its users.

12. INTERNATIONAL DATA TRANSFERS


12.1 International Scope of the Services.
Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) operates and may provide the Services to users located in different jurisdictions. Accordingly, information processed in connection with TASK321 may be collected, accessed, stored, processed, analyzed, transmitted, backed up or transferred within and outside the country, state or jurisdiction in which the User, the data subject, Fusion or any of its providers, affiliates, subprocessors or Third-Party Services are located.

12.2 International Transfers.
The User acknowledges and agrees that information processed in connection with the Services may be transferred internationally to jurisdictions that may not offer the same level of data protection as the country of residence of the User or the data subject.
Such transfers may be necessary or convenient to:
a. operate, host, maintain and scale the Services;b. use cloud providers, infrastructure, support, security, analytics, messaging, payment, artificial intelligence, automation, telephony, voice, transcription, authentication, electronic signature, calendar, mapping, marketplaces or other third parties;c. perform backups, disaster recovery, monitoring, observability, auditing, debugging, support or incident investigation;d. comply with legal, regulatory, contractual or security obligations;e. sustain the technical, commercial and global operation of TASK321.

12.3 International Recipients.
International transfers may involve, among others:
a. affiliates, parent companies, subsidiaries or entities under common control;b. subprocessors and technology infrastructure providers;c. payment processors and financial third parties;d. messaging, voice, telecommunications, campaign or automation providers;e. artificial intelligence, machine learning, classification, automation or equivalent technology providers;f. advisors, auditors, consultants, investigators, compliance providers or forensic specialists;g. authorities, courts, regulators or other third parties when required or permitted by applicable law.

12.4 Safeguards and Protection Mechanisms.
Where applicable legislation requires safeguards or specific mechanisms for international data transfers, Fusion may rely on any mechanism recognized or reasonably appropriate under such legislation, including, without limitation:
a. standard contractual clauses or model contractual clauses;b. data processing agreements or transfer addenda;c. adequacy decisions or equivalent mechanisms recognized by competent authorities;d. binding corporate rules or other internal organizational mechanisms, where applicable;e. explicit consent of the data subject where legally valid;f. any other legally permitted basis or mechanism for international transfer.

12.5 Operational Necessity and Acceptance.
Use of the Services implies the User’s acknowledgment and acceptance that information may be transferred, hosted and processed outside their local jurisdiction to the extent reasonably necessary to operate, protect, monetize, maintain, integrate, improve or scale TASK321.
If the User does not accept that their information or the information processed through their account may be subject to international transfers, the User’s sole remedy shall be not to use the Services or to refrain from uploading information to them.

12.6 User Responsibility for Third-Party Data.
Where the User uploads, synchronizes, processes or permits the processing of personal data of customers, leads, employees, contractors, suppliers or third parties through the Services, the User shall be solely responsible for evaluating whether the User possesses the authorizations, notices, legal bases, consents or mechanisms required to permit international transfers of such data in accordance with applicable legislation.
Fusion shall not be responsible for the User’s failure to comply with local, sectoral or contractual restrictions applicable to information incorporated by the User into TASK321.

12.7 Regulatory Differences Between Jurisdictions.
The User acknowledges that different jurisdictions may impose different requirements regarding governmental access, data retention, exercise of rights, security, data localization, transparency, international transfers, advertising, telecommunications or the processing of specific categories of information.
Fusion may adapt, limit, supplement or document its international transfer practices when necessary to comply with applicable regulatory requirements or to sustain the global operation of the Services.

12.8 Transfers Derived from User Integrations.
Where the User enables or uses integrations, APIs, connectors, communication channels, payment processors, artificial intelligence tools or any Third-Party Service, the User acknowledges that such decision may involve additional international transfers carried out by those third parties under their own terms, policies and practices.
Fusion does not fully control the location of infrastructure, subprocessors or data centers used by third parties integrated with or activated by the User.

12.9 Remote Access and Global Support.
Fusion and its providers may remotely access information processed in the Services from different jurisdictions for purposes of support, security, monitoring, auditing, compliance, analysis, maintenance, incident response, investigation, debugging, product improvement or operational continuity, to the extent reasonably necessary and in accordance with this Policy.

12.10 International Backups and Storage.
Information may be stored or replicated in backups, logs, redundant systems, disaster recovery environments, support environments or distributed infrastructure located in multiple jurisdictions. The User acknowledges that deleting data from an active environment does not necessarily imply simultaneous and immediate deletion in all international backup copies or derived systems.

12.11 No Guarantee of Exclusive Data Localization.
Unless Fusion expressly agrees otherwise in writing in a specific document, Fusion does not guarantee that information will remain hosted, processed or accessible exclusively within a particular jurisdiction, nor that the Services will be provided solely through infrastructure located in a single country or territory.

12.12 Requests Related to Transfers.
Where required by applicable law, Fusion may provide general information regarding the international transfer mechanisms applicable to certain categories of data or processing activities, subject to reasonable limitations relating to confidentiality, security, trade secrets, infrastructure protection, legal privilege and operational feasibility.

12.13 Broad and Functional Interpretation.
This Section shall be interpreted broadly to allow Fusion to carry out, sustain, document and protect international transfers of information to the extent reasonably necessary to operate, scale, integrate, secure, monetize, improve and enforce TASK321, even where a specific jurisdiction, provider, technology, infrastructure or transfer flow is not expressly identified in this Policy.


13. DATA SUBJECT RIGHTS



13.1 General Rights.
Subject to applicable legislation, the nature of the information processed, the role of Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) with respect to the data, and the corresponding legal limitations, exceptions or requirements, data subjects may have the right to request, as applicable:
a. access to their personal data;b. confirmation of whether Fusion processes certain personal information;c. correction, rectification or updating of inaccurate, incomplete or outdated data;d. deletion, erasure, anonymization or blocking of information;e. restriction of or objection to certain processing activities;f. data portability, where applicable;g. limitation of the use of sensitive information where provided by law;h. withdrawal of consent where processing validly depends on such consent;i. review of certain automated decisions where applicable legislation grants such right;j. submission of complaints before competent supervisory or data protection authorities.

13.2 Scope of the Rights.
The rights described in this Section are not absolute and may be subject to reasonable limitations, conditions, exceptions, identity verification requirements, formal requirements and restrictions established by applicable law, including situations in which the information must be retained for legal, regulatory, contractual, operational, security, legal defense, fraud prevention, auditing or protection of the rights of Fusion or third parties.

13.3 Identity Verification.
Before responding to, processing or complying with a request related to personal data, Fusion may require information, documentation or additional steps reasonably necessary to verify the identity, authority, standing or representation of the requester and to prevent fraud, improper access, malicious requests or unauthorized disclosures.
Fusion may reject or limit requests where it is not reasonably possible to verify the identity or authority of the requester.

13.4 Requests Related to Data Controlled by the User.
Where Fusion processes personal data primarily on behalf of a Business User or in an equivalent role as processor, service provider or contractor with respect to information uploaded by such User for purposes related to its business, Fusion may:
a. forward the request to the corresponding User;b. indicate to the requester that they should contact the responsible User directly;c. act in accordance with valid instructions from the User where applicable legislation permits; ord. limit its intervention to the extent that it does not act as the primary or independent controller with respect to such data.
Fusion shall not be responsible for the absence of response, delay or decision adopted by the responsible User with respect to requests relating to data primarily controlled by that User.

13.5 Access Requests.
Where applicable, data subjects may request confirmation of whether Fusion processes their personal data and, if so, reasonable access to certain categories or copies of such information, subject to limitations relating to security, trade secrets, third-party rights, legal privileges, infrastructure protection and other restrictions provided by law.

13.6 Correction Requests.
Fusion may correct, update or supplement personal data where the requester reasonably demonstrates that the information processed is inaccurate, incomplete or outdated, provided that Fusion is reasonably able to perform such correction and that doing so does not contradict applicable legal, contractual, evidentiary or technical obligations.

13.7 Deletion or Erasure Requests.
Fusion may evaluate requests for deletion, erasure, blocking or anonymization of personal data in accordance with applicable legislation, its role with respect to the information, the Terms and Conditions, this Policy and the legal bases that justify the retention of such information.
Fusion may reject, limit, defer or condition a deletion request where a legal, regulatory, contractual, technical, operational or security obligation justifies the retention of all or part of the information, including retention for:
a. payments, billing, auditing or debt recovery;b. fraud prevention and security;c. preservation of evidence and legal defense;d. compliance with regulatory or judicial requirements;e. maintenance of backups, logs, traceability or system integrity;f. protection of the rights, intellectual property, operations or legitimate interests of Fusion.

13.8 Withdrawal of Consent.
Where Fusion processes information based on consent and applicable law allows its withdrawal, the data subject may withdraw such consent at any time. Withdrawal shall not affect the lawfulness of processing carried out prior to the withdrawal nor prevent Fusion from continuing to process the information where another valid legal basis exists.

13.9 Objection, Restriction and Limitation.
Where applicable legislation provides for it, the data subject may request objection, restriction or limitation with respect to certain processing activities. Fusion shall evaluate such requests on a case-by-case basis, taking into account its role with respect to the data, the purpose of the processing, the legitimate interests involved, the existence of legal or contractual obligations and the technical and operational feasibility of the requested measure.

13.10 Data Portability.
Where applicable legislation recognizes a right to data portability, Fusion may provide, to the extent reasonably possible and legally required, access to certain personal information in a structured, commonly used or technically reasonable format, subject to limitations relating to security, trade secrets, third-party rights, system protection, technical complexity and other applicable restrictions.

13.11 Timing and Method of Response.
Fusion shall endeavor to respond to valid requests within the timeframes required by applicable legislation or, where no specific timeframe is established, within a reasonable period considering the nature of the request, the complexity of the case, the volume of data involved, the need for identity verification, coordination with Business Users or third parties, and applicable technical or operational limitations.
Fusion may extend the response period where reasonably necessary and permitted by law.

13.12 Excessive, Repetitive or Unfounded Requests.
Fusion may reject, limit, postpone, charge a reasonable fee or require additional clarification regarding requests that are manifestly unfounded, excessive, repetitive, abusive, technically disproportionate, fraudulent or formulated in terms that prevent reasonable identification of the information or right invoked, to the extent permitted by applicable law.

13.13 Non-Discrimination, Subject to Applicable Law.
Where required by applicable legislation, Fusion shall not improperly discriminate against a data subject for exercising privacy rights. However, Fusion may differentiate, restrict, suspend, limit or condition services, functionalities, pricing, communications or access where reasonably necessary to operate the Services, comply with legal obligations, apply security measures, prevent fraud, respect technical configurations or where the requested service depends on the processing of information whose limitation or deletion renders the service unfeasible.

13.14 Supervisory Authorities and Complaints.
Data subjects may have the right to submit complaints to supervisory authorities, data protection authorities, consumer protection agencies or other competent regulatory bodies in their jurisdiction. Notwithstanding the foregoing, Fusion encourages data subjects to contact the channel indicated in this Policy first in order to attempt to resolve the matter directly and reasonably.

13.15 Broad and Functional Interpretation.
This Section shall be interpreted broadly in order to recognize and manage data subject rights in accordance with applicable legislation, without obligating Fusion to assume responsibilities, roles or burdens that do not legally correspond to it with respect to data primarily controlled by Business Users or independent third parties.

13.16 Automated Processing and Automated Decisions.
Fusion may use automation tools, classification systems, prioritization mechanisms, recommendation systems, operational scoring, artificial intelligence, automated rules, decision engines and equivalent technologies in order to operate, assist, organize, route, suggest, filter or improve certain functionalities of TASK321.
Unless expressly indicated otherwise for a specific functionality, this does not necessarily imply the adoption of solely automated decisions that produce significant legal effects on an individual or equivalent decisions under applicable legislation.
Where applicable legislation grants specific rights regarding automated decisions, profiling or similar processing, Fusion shall evaluate and address such requests to the extent that they are legally valid, technically feasible and compatible with Fusion’s role with respect to the data involved.


14. ROLE OF BUSINESS USERS AND DATA CONTROL



14.1 Business Users as Primary Controllers of Their Business Data.
Where a user uses TASK321 on behalf of a company, business, independent professional, operational team or any organization to manage customers, leads, contacts, employees, contractors, suppliers, schedules, quotations, messages, payments, jobs, automations or any other activity related to its operations (the “Business User”), such Business User shall, in principle, be the primary or independent controller with respect to the personal data and other information that it decides to collect, upload, import, synchronize, organize, use, communicate or process through the Services for purposes related to its business.

14.2 Decisions of the Business User.
The Business User shall be solely responsible for defining, with respect to the information incorporated into TASK321 for purposes of its activities:
a. the purpose of the processing;b. the applicable legal basis or legal grounds;c. what data it collects, uploads, imports, synchronizes or retains;d. whom it contacts, how frequently and through which channel;e. what messages, quotations, responses, campaigns, automations or integrations it activates;f. how long the information is retained;g. what instructions it provides to its employees, contractors, sub-users or third parties;h. which third parties or integrations it connects with TASK321;i. what security, access and data governance measures it implements within its organization.

14.3 Limited Role of Fusion.
Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) acts as a provider of technological infrastructure, software and related services. Except where applicable law expressly provides otherwise for specific activities carried out by Fusion for its own purposes, the fact that a Business User uses TASK321 to process third-party data does not automatically make Fusion the primary, exclusive or joint controller of such data.
Depending on the nature of the processing and applicable legislation, Fusion may act as a service provider, processor, subprocessor or equivalent role with respect to the information processed by the Business User within TASK321.

14.4 Obligations of the Business User.
The Business User represents, warrants and agrees to:
a. collect and process personal data of customers, leads, employees, contractors, contacts and third parties in accordance with applicable legislation;b. possess the legal bases, consents, notices, permissions, authorizations or justifications necessary to upload and process such data within TASK321;c. adequately inform data subjects where required by applicable law;d. be responsible for the accuracy, lawfulness, timeliness, quality, legitimacy and relevance of the information incorporated into the Services;e. comply with applicable obligations relating to privacy, data protection, telecommunications, marketing, consumer protection, labor relations, financial services and any other regulation relevant to its activity;f. adopt reasonable internal security measures with respect to its account, personnel, access credentials, integrations and operational workflows.

14.5 Communications, Marketing and Messaging by the Business User.
Where the Business User uses TASK321 to send messages, emails, SMS, WhatsApp messages, calls, automated responses, reminders, campaigns, quotations, confirmations or other communications to customers or third parties, the Business User shall be solely responsible for:
a. having sufficient consents, permissions or legal bases for such communications;b. verifying the accuracy of recipients, timing, content, frequency and purpose;c. complying with marketing, telecommunications, commercial messaging, privacy and consumer protection regulations;d. responding to any claim, investigation, fine, sanction or dispute arising from such communications.

14.6 Data of Employees, Contractors and Subusers.
Where the Business User uploads or manages data of employees, technicians, operators, contractors, subcontractors, representatives or sub-users within TASK321, the Business User shall be solely responsible for possessing the notices, legal bases, internal authorizations or contractual frameworks required for such processing, as well as defining and controlling the access, permissions, roles and limits of use of such individuals.

14.7 Customer and Third-Party Data.
Fusion does not verify by default whether the data of customers, leads, contacts, suppliers or other third parties uploaded by the Business User is accurate, current, legitimate or properly authorized. Responsibility for the collection, import, synchronization, use, retention, sending, automation or deletion of such data shall remain primarily with the Business User.

14.8 Data Subject Rights Requests.
Where a data subject exercises rights regarding information that a Business User has incorporated or processed through TASK321 for its own business purposes, Fusion may forward such request to the corresponding Business User, act in accordance with valid instructions from that user, or limit its intervention to the extent that it does not act as the primary controller with respect to such data.

14.9 Integrations Activated by the Business User.
Where the Business User connects payment processors, CRM systems, calendars, messaging platforms, WhatsApp services, telephony systems, artificial intelligence tools, maps, automations, electronic signature tools, biometric systems, marketplaces or any other Third-Party Service, the Business User shall be solely responsible for evaluating whether such integration is appropriate for its operations and whether it possesses the necessary permissions, consents, notices and legal bases to share information with such third parties.

14.10 Operational Independence of the Business User.
The intensive use of TASK321 by the Business User does not make Fusion the operator of the Business User’s business, nor responsible for its commercial decisions, pricing, quotations, jobs, assignments, messages, campaigns, employees, customers, collections or regulatory compliance.

14.11 Limitation of Fusion’s Role with Respect to Business User Data.
Nothing in this Policy shall be interpreted as a general assumption by Fusion of obligations that legally or contractually correspond to the Business User with respect to data, communications, campaigns, integrations, automations or services that such Business User manages through TASK321 for purposes related to its business.

14.12 Cooperation and Requests.
Fusion may request from the Business User information, documentation, clarifications or reasonable cooperation where necessary to respond to requests from data subjects, authorities, claims, security incidents, audits, disputes, chargebacks, investigations or any situation related to data processed by the Business User through TASK321.

14.13 Broad and Functional Interpretation.
This Section shall be interpreted broadly in order to preserve the role of Fusion as a technology provider and to prevent the attribution to Fusion of responsibilities that correspond primarily to the Business User with respect to the data, content, communications, automations, integrations or operational decisions that the Business User incorporates or executes through the Services.

15. MINORS



15.1 Services Intended for Adults and Commercial Activities.
The Services offered by Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) are primarily designed to be used by adults, professionals, companies, work teams, independent contractors or organizations that operate commercial, professional or technical activities.
TASK321 is not directed to, nor specifically designed for, minors.

15.2 Restriction on Use by Minors.
Individuals under the minimum legal age required to enter into binding contracts in their jurisdiction shall not create accounts, register for or use the Services without the supervision and authorization of a parent, legal guardian or authorized representative.
To the extent permitted by applicable legislation, Fusion may reject, suspend or terminate accounts where it has reasonable knowledge that such accounts have been created or used by minors without appropriate authorization.

15.3 Information About Minors Incorporated by Business Users.
In certain cases, Business Users may incorporate into TASK321 information relating to minors (for example, customers, family members, contacts, participants in services, beneficiaries or third parties associated with the Business User’s activities).
In such cases, the Business User shall be solely responsible for:
a. possessing the authorizations, consents or legal bases necessary to collect and process such information;b. complying with applicable laws relating to the protection of minors’ data;c. adequately informing parents, guardians or legal representatives where required by applicable legislation;d. limiting the collection and use of minors’ information to what is strictly necessary for their activities.
Fusion does not, by default, verify whether the data uploaded by the Business User relates to minors nor whether the necessary authorizations have been obtained.

15.4 Deletion of Minors’ Information.
If Fusion becomes reasonably aware that personal information of a minor has been collected or processed directly by Fusion in violation of applicable legislation, Fusion may take reasonable measures to delete, restrict or block such information, subject to legal retention obligations or reasonable technical limitations.

15.5 Responsibility of the Business User.
Where a Business User uses TASK321 to process information relating to minors within the scope of its commercial activities, Fusion shall not be responsible for the collection, accuracy, legitimacy, consent, communication, storage or use of such information, and the Business User shall assume the corresponding obligations toward the data subjects, their legal representatives or the competent authorities.

15.6 Communications Related to Minors.
The Business User shall be solely responsible for any communication, message, notification, reminder, campaign, automation or interaction sent to minors or related to minors through TASK321, including compliance with privacy, child protection, telecommunications and marketing regulations applicable in its jurisdiction.

15.7 Broad and Functional Interpretation.
This Section shall be interpreted broadly in order to protect minors, limit the improper processing of children’s information and preserve Fusion’s role as a technology provider when the Services are used by Business Users that process data of minors within the scope of their own activities.


16. CHANGES TO THIS PRIVACY POLICY


16.1 Right to Modify.
Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) may modify, update, replace, expand or adjust this Privacy Policy at any time when it reasonably considers it necessary for legal, regulatory, technical, operational, commercial, security or service evolution reasons.

16.2 Reasons for Updates.
Modifications may be made, among other reasons, to:
a. reflect changes in the Services, functionalities, integrations or technologies used;b. incorporate new tools, modules, automations, integrations or providers;c. adapt to legislative, regulatory or case law changes;d. update internal security, privacy or compliance practices;e. improve the clarity, precision or structure of the Policy;f. reflect changes in the commercial, operational or technical model of TASK321.

If the User does not agree with a relevant update to the Policy, the User may cease using the Services or close their account in accordance with the applicable Terms and Conditions.

16.6 Material Changes.
Where modifications introduce material changes in the way Fusion processes personal information, Fusion may, where required by applicable law or where it considers it reasonable, provide additional notices or acceptance mechanisms before such changes take effect.

16.7 Historical Versions.
Fusion may retain prior versions of this Policy for purposes of auditing, compliance, contractual traceability, dispute resolution, incident investigation or legal defense.

16.8 No Obligation of Individual Notice.
Unless applicable law provides otherwise, Fusion shall not be required to individually notify each user of every modification made to this Policy. Publication of the updated version through reasonable means shall be considered sufficient for purposes of transparency and notice.

Communications addressed to Fusion may be submitted in English or in other reasonable languages. Fusion may respond in the language in which it is reasonably possible to manage the request.

17.6 Additional Channels.
Fusion may establish additional contact channels for matters related to privacy, technical support, compliance, security incidents or regulatory requests where this is considered convenient for the administration of the Services.

17.7 Broad and Functional Interpretation.
This Section shall be interpreted broadly in order to facilitate reasonable communication between users and Fusion regarding matters related to privacy, without creating additional obligations beyond those provided by applicable legislation or by the contractual agreements governing the use of the Services.


18. REGULATORY COMPLIANCE AND APPLICABLE JURISDICTIONS



18.1 International Scope of Compliance.
Fusion Engineering Group LLC (“Fusion”, “TASK321”, “we”, “us”, “our”) provides services to users located in different jurisdictions and seeks to operate its Services in a manner reasonably consistent with applicable regulatory frameworks relating to privacy and data protection.
However, due to the global nature of the internet and SaaS services, applicable laws may vary between jurisdictions.

18.2 Reference Legislations.
Depending on the location of the user or the data subject, the processing of information may be subject, among others, to regulations such as:
